Terms & Conditions
Moshulu.co.uk declare that they are willing to trade on the following conditions and unless varied by the Company in writing the general conditions of trading apply to orders accepted by the Company to the exclusion of any other terms and conditions subject to which any quotation is accepted or purported to be accepted or any such order is made or purported to be made by the buyer. No agent or employee of the Company is permitted to alter or vary these conditions unless he is expressly authorised in writing to do so. Our agreement is made on the date we deduct the payment from your credit card. Our agreement includes all correspondence.
Customer’s orders shall be deemed to be given on the basis of these Conditions and will be so accepted by the Company.
Delivery will be made by the Company delivering the goods to such place as is agreed between the Company and the Buyer. The Company will endeavour to deliver the Goods within the time agreed and if no time is agreed within a reasonable time, but in no circumstances will the Company be liable for loss or damage of any kind whatsoever caused directly or indirectly by any delay in the delivery of the goods. No claim for damage or shortages will be considered unless the Company is advised in writing within 3 days of delivery by the Buyer.
'Working Day' and 'Business Day' in the context of our delivery services means Monday, Tuesday, Wednesday, Thursday and Friday. We do not currently despatch or deliver on Saturday or Sunday. Orders placed between 3pm Thursday and 3pm Friday will be dispatched Friday. Orders placed between 3pm Friday and 3pm Monday will be dispatched Monday.
Property in the Goods
The property (both legal and equitable) in the goods supplied under this contract (in this clause referred to as “the Supplied Goods” which expression includes any of them) shall not pass to the Buyer until : - The purchase price of the Supplied Goods has been paid in full : Nor shall property pass until : - Payment by the Buyer to the Company of any sum which is now or may hereafter become due and owing from the buyer to the Company
The goods shall be at the buyer’s risk when the Company delivers them in accordance with the Contract Provisions to the Buyer or its agent or other person to whom the Company has been authorised by the Buyer to deliver the Goods.
Prices will be those indicated on the website unless otherwise agreed. and while every effort will be made to hold quoted prices for as long as possible, the company reserves the right to increase prices without notice. All prices are inclusive of VAT where applicable.
Free 28 days returns policy. We want you to be completely satisfied with your new purchase from us. Perhaps they were not what you were expecting, they didn’t fit, didn’t match your outfit or aren’t as ordered. If for any reason, you’re not happy with your items, you can return them to us free of charge (by using the returns note supplied in your parcel) unworn in their original packaging within 28 days for a refund. Except in respect of death or personal injury caused by the Company’s negligence, the Company shall not be liable to the Buyer by reason of any representation or any implied warranty, condition or other germ or any duty at common law or under the express terms of the contract for any consequential loss or damage (whether for loss of profit or otherwise) costs, expenses or other claims for consequential compensation whatsoever (and whether caused by the negligence of the Company, its employees or agents or otherwise) which arise out of or in connection with the supply of the Goods or their use or resale by the Buyer, except as expressly provided in these conditions. Where the Goods are sold under a consumer transaction (as defined by the Consumer Transactions (Restrictions or Statement) order 1976) the statutory rights of the Buyer are not affected by these conditions.
No drawings descriptive matter dimensions issued by the Company or the manufacturer of the Goods nor the descriptions, illustration or other information or statements contained in the Company’s or manufacturer’s catalogues, price lists and other advertising matter shall be deemed to form part of the Contract nor be regarded as a warranty or representation relating to the goods.
Intellectual Property Rights
All logos, graphics, images of products and descriptions of products on this website are the intellectual property of Coastguard Road Ltd and may not be used without express written permission from the Company.
You warrant that the information entered onto the order form is true.
The Company will be entitled to assign sub-contract or sublet the contract or any part thereof. Failure by the Company to enforce any of the contract provisions will not be construed as a waiver of any of its rights hereunder. The legal construction of these clauses shall not be affected by their headings which are for convenience of reference only. Each and every Clause and Sub-Clause is divisible and severable from each and ever other such Clause and Sub-Clause and if any such Clause or Sub-Clause is found by any court to be unreasonable and therefore void the Contract provisions shall be read as if the same were omitted therefrom. Where appropriate herein words importing the masculine shall include the feminine and the neuter, the singular shall include the plural and vice versa in each and every case as aforesaid.
The formation, interpretation and operation of the Contract will be subject to English Law and the Buyer submits himself to the non-exclusive jurisdiction of the English Courts. Coastguard Road Ltd. is a member of the Instock Footwear Supplier’s Association and these conditions have been prepared from the Association’s standard trading terms.
