11th April 2018 - We love to create a smile with every purchase. To enable all of our customers to take advantage of all we have to offer we're phasing out our loyalty points scheme. This will allow us to give you more of our very best offers, great competitions, and even the occasional surprise!
From 8th May 2018 points will no longer be earned on purchases, however existing points can still be spent online, in store and over the phone until 8th November 2018.
Our Loyalty Scheme
We're saying a big thank you by allowing you to register on the loyalty scheme when you place an order with us. You will be awarded 1 point for each complete £1 (excluding P&P) that you spend in a single transaction and these points can be redeemed for future full price purchases that you make through the website and in store.
Loyalty Scheme Terms
1.These terms and conditions are applicable across the entire loyalty scheme (previously known as Colour Club) and any participation whether by registration or use of loyalty points is considered as acceptance of the terms
2.Within these terms any reference to 'us' or 'we' or 'Moshulu' means Coastguard Road Ltd of Devonshire Road, Heathpark, Honiton, EX14 1SD who are the promoters of the scheme
3.For the purpose of the scheme communications from members to Moshulu can be made in writing at the above address, via firstname.lastname@example.org or by telephone 01404 540789
4.Moshulu reserves the right to change these terms and conditions from time to time by giving members not less than 28 days notice.
5.The Company will be entitled to assign sub-contract or sublet the contract or any part thereof. Failure by the Company to enforce any of the contract provisions will not be construed as a waiver of any of its rights hereunder. The legal construction of these clauses shall not be affected by their headings which are for convenience of reference only. Each and every Clause and Sub-Clause is divisible and severable from each and ever other such Clause and Sub-Clause and if any such Clause or Sub-Clause is found by any court to be unreasonable and therefore void the Contract provisions shall be read as if the same were omitted therefrom. Where appropriate herein words importing the masculine shall include the feminine and the neuter, the singular shall include the plural and vice versa in each and every case as aforesaid.
6.The scheme is valid on the Moshulu.co.uk web site and in store. It is not valid on any other website.
7.The points allocated through the scheme are personal to the Moshulu loyalty account holder to which the points have been allocated. They cannot be transferred to any other person or account. Nor can they be sold, or traded on any way.
8. Full details of how points are collected and how they may be redeemed can be found by reading the section below on how I can collect and redeem points. Please read this section carefully as it forms part of the loyalty scheme terms.
9.The scheme is intended for personal use. Points cannot be collected for use by any business.
10.Moshulu do not accept any liability for loyalty scheme accounts that have been sabotaged due to any actions of the account holder.
12.We reserve the right, at any time and without notice, to end the scheme or decline any membership to the scheme.
13.We can take any action we believe to be appropriate if we have reason to believe that you are abusing the scheme, including withholding points previously credited to your loyalty scheme account.
14.We may modify the terms of the scheme in any way that we choose at any time. These terms and conditions replace all previous versions, are correct as of 13 October 2017 and shall be governed by and construed in accordance with the laws of England, and any disputes will be decided only by the English courts. Moshulu reserves the right to change these, at any time for legal, regulatory, business or policy reasons. Members who continue to participate in the scheme following such a change will be considered to have accepted the updated terms and conditions.
15.The loyalty scheme is not available to employees of Coastguard Road Ltd.
How do I collect and redeem Points?
16.You will be allowed to register on the loyalty scheme when you place an order with Moshulu online, over the phone or in store. To collect points for an order you must provide identifying personal details including an email and postal address.
17.Points may also be earned for engaging in qualifying activities. Mohsulu reserves the right o reduce or vary the range of qualifying activities and the rate of points accrual for such activities at any time.
18.You will be awarded one point for every complete £1 that you spend in a single transaction, excluding shipping costs. This can be altered at our discretion. We may also set a limit on the number of points which can be earned.
19.Moshulu will remove Points at any time if products are returned for any reason and a full or partial refund of the purchase price if given. This also applied to the exchange of products, unless exchange of products with an equivalent points value.
20.You will be able to see the number of points you have earned in the ‘Account’ section of our website or by contacting Customer Care.
21.You can redeem your points against online, instore and telephone orders of full prices items totalling a minimum of £35 (before shipping) when you hold a total of 100 points or more. The current redemption value of points is one points equal to 5 pence. We reserve the right to vary the rate at any time.
22.Loyalty points cannot be used against shipping costs.
23.Loyalty points cannot be redeemed in conjunction with any other offer including discounted products prices.
24.All loyalty points will be valid from 24 months from issue.
25.Points awarded at the time of the transaction or vouchers already issued may be removed or cancelled if Moshulu determined that the points were collected in breach of these terms and conditions or were awarded in error. For the avoidance of doubt, any advice or actions of our staff that is contrary to these terms and conditions will not have the effect of changing thee terms and conditions.
26.Moshulu is under no obligation to award points for any reason outside the qualifying transactions.
Colour Club Card
The Colour Club as of August 2017 is terminated and replaced by the new Loyalty Scheme. Any terms of that club are hereby replaced by the terms above. All existing Colour Club Members have been transferred to the new scheme.
In respect of existing Colour Club Cards the following terms apply;
27. Colour Club Cards in whatever form, are issued by and remain the property of Moshulu which may, at any time, terminate the scheme or alter or amend the conditions of operation of the scheme.
28. The Colour Club card, in whatever form, is not transferable, cannot be copied and can only be used by the member who is named and registered for the card.
29. Possession of a Colour Club Card does not confer membership of the Colour Club
Colour Club Discount Vouchers
36. Colour Club Points will be converted to Colour Club Discount Vouchers at specified times of the year. Moshulu reserves the right to change the dates of these conversion by giving 28 days notice to members
37. Colour Club Points above a specified minimum threshold will be converted at the prevailing rate on the conversion date and will be converted in multiples of the minimum conversion number with the balance carried over to the next conversion date. Moshulu reserves the right to alter the minimum threshold by giving 28 days notice to members.
38. Points earned within one calendar month of the conversion date will not be eligible for conversion and will be carried over to be converted at the next conversion date subject
39. Colour Club Discount Vouchers will be issued with a time limit for their use. Expired vouchers will not be accepted
40.Where these terms differ from statements made on other loyalty materials these terms will take precedence
